RULES AND REGULATIONS RULES AND REGULATIONS Ratified by the Board of Governors at the September 13, 2007. Additional Rules and Regulations may be found in the By-laws._______________________________________________________________________________ 1. OBSERVATION OF RULES All Property Owners are expected to observe all the Rules and Regulations and to report, preferably in writing to the Property Manager, any person who does not comply with any rule. 2. COMPLAINTS ABOUT PROPERTY MANAGEMENT OR GATE GUARD PERSONNEL. Property Owners may not discipline or verbally abuse Property Management or Gate Guard personnel. Complaints regarding Gate Guard personnel should be directed to the Chairman of the Gate Access Committee. Complaints regarding Property Management Personnel should be directed to the President of the Board of Governors. 3. ARCHITECTURAL APPROVAL Any changes to the exterior appearance of your home must have prior approval of the Association Architectural Committee, (i.e.) new construction, remodeling, landscape changes, pool construction, roof replacement, painting, driveway replacement, etc. Reference: By-laws, Article VIII, Section 4. 4. DAMAGE TO PROPERTY Costs for damage(s) to Association property, by any Home Owner, their family, or their guests, must be borne by the Home Owner. 5. LAUNDRY No outside hanging of laundry or other materials is permitted. 6. LIGHTING A minimum of one exterior post light shall be installed in the front of the house to provide street lighting. These lights may be activated by a dusk to dawn photo cell or timing device. External flood lights are required on all four corners of the residence. 7. Mailboxes The mailbox, post and numbering scheme, shall be in the form, appearance, and of the type, size, and color, and other attributes acquired and installed by the Association. Initial mailboxes, posts, and numbering scheme, are furnished by the Association. All subsequent replacements will be provided by the association, at the Property Owner's expense. The mailboxes will be refurbished periodically by the Association, as required. 8. MAINTENANCE Property Owners are required to maintain their roofs, driveways, home exteriors and any walls or fences, in a good state of repair and appearance. All lawns and landscaping shall be trimmed and provide a neat appearance. Roadside hedges shall be maintained in accordance with the existing Palm Beach County codes affecting the maximum height and set back from the road edge. Overhanging trees must be trimmed to allow a minimum of fourteen feet overhead clearance from the road surface, allowing safe passage for all truck traffic. The dumping of landscaping debris, tree cuttings, trash or construction debris on vacant lots is prohibited. 9. MOTOR HOMES, BOATS, TRAILERS, TRUCKS, ETC. No trailers, boats, motor homes, other habitable motor vehicles of any kind, all-terrain vehicles, or jet skis, etc., shall not be stored on any part of the property, except within an enclosed residential garage. All trucks shall be parked overnight within an enclosed residential garage. This includes pick-up trucks. Re: By-laws, Article VIII, Section 4, G (2), (a) and (b). Requests for temporary exceptions should be directed to the Chairman of the Gate Access Committee. 10. UNLICENSED VEHICLES Motor vehicles unlicensed by the State of Florida are prohibited from the use of Association streets or any vacant lots. This includes motorized golf carts, skateboards, mopeds, etc. 11. PETS All pets must be on a leash when being walked. The “Pooper Scooper” ordinance must be strictly followed by the Property Owner. Pets may not create a nuisance or disturbance to other Property Owners. 12. PRIVACY Association Membership Rosters are for the exclusive personal use of the Property Owners only. Do not allow the unauthorized use of this information. 13. REAL ESTATE SALES Property Owners must notify the Home Owners Association (HOA) when their property has been listed for sale, and identify the listing realtor, if applicable. A realtor must accompany their clients, within the same vehicle, with the exception of those homes listed by the owner. In the latter case, the owner may add prospective buyers to their temporary access list. All realtors must show a photo ID and their realtors license, to the Gate Guard. In the event the Gate Guard has not been contacted, by either the Property Owner or the listing realtor regarding a property showing, a call will be initiated to the Property Owner. Entry will be denied if the Property Owner is not available. Properties may be shown seven days a week between the hours of 7:00 AM & 7:00 PM.
Driving and/or parking by any type of licensed or unlicensed vehicle on vacant lots is strictly prohibited. 15. WASTE MATERIAL PICK-UP Solid Waste Authority has scheduled pick-ups on Tuesday and Friday. Tuesday is for trash and recyclables; Friday is for trash and lawn/tree debris. Materials should not be set out before 6:00 PM the evening before scheduled pick-up. Empty containers should be retrieved as soon as possible after the pick-up. All landscaping debris must be bagged, with the exception of tree trimmings (to be placed curbside). Do not place any waste materials on vacant lots. 16. ASSESSMENT Annual Assessments are levied by the Board of Governors for Gate Access Operations and General Operations of the HOA. The Gate Access assessment (base on improved lot status) is due and payable in two equal installments, on the first day of January and the first day of July. The General Assessment is due and payable in full on the first day of January. SPECIAL MAINTENANCE FEES May be assessed against any member who fails to maintain his or her property in a satisfactory manner. Default in the payment of an assessment may result in the imposition of administrative costs and interest. If the default continues after notice to the defaulting member, legal actions through the court system may be pursued. 17. PARKING All vehicles shall park off the roadways, where possible. If this is not possible, vehicles should be parked on same side of the street, facing in the same direction. Parking on the grassed areas, at any time, is Prohibited. 18. SOLICITING Absolutely “No Soliciting” is allowed on Pine Tree properties. Companies, vendors, or individuals found soliciting may be denied future access into Pine Tree. 19. VEHICLE OPERATION The posted speed limit within the community is 25 miles per hour. All STOP signs will be obeyed. Please exercise extreme caution when approaching walkers, joggers, and children at play. When entering Military Trail from the community, please allow only one vehicle in the median at a time. 20. HOURS OF OPERATION The hours of operation for contractor personnel and service providers are from 7:00 AM to 6:00 PM, Monday thru Saturday during Day Light Savings Time and from 7:00 AM to 5:00 PM at all other times. No Work is permitted on Sundays and Holidays. 21. PROPERTY RENTAL No owner/member shall be permitted to rent, lease or otherwise permit the use of his/her property by a non-member more than once in any continuous twelve month period. Prior to a particular rental, lease or other use, the owner/member shall submit an application to the Board of Governors, accompanied by a check for $150.00. The application may be obtained from the Property Manager. The owner/member and the new occupant shall be responsible for compliance with all requirements and restrictions (set forth in the Association By-laws and Rules and Regulations), and subject to their enforcement. 22. FLAG POLE INSTALLATION An owner/member may install a flag pole on their property provided they comply with the following: Submit an application for the installation of a flag pole, citing the dimensions and location of the pole. The pole height may not exceed 25’-0”, and be made of non-rusting metal, designed to withstand wind gusts up to 90 MPH. The American Flag must not exceed 48” x 72” and always be flown at the top of the pole. If the flag is to be flown during hours of darkness, then appropriate illumination is required. Organizational flags may also be flown beneath the American Flag. Application forms may be obtained from the Property Manager. 23. BAR CODES FOR OWNERS Bar codes shall be assigned only to owners. If an owner vacates a present home and rents another, and if the management company has an application on file and the President has signed an Approval of Occupancy, the owner may retain any assigned bar code(s) as long as ownership of the present home is maintained. |
